Part B: Special Education Update

Reevaluations (Cases where parent and public agency agree that a reevaluation is unnecessary)

Iowa Code indicates that a reevaluation must occur at least once every three years, unless the parent and public agency agree that a reevaluation is unnecessaryThe Reevaluation Page has been modified to articulate this potential decision.  When the AEA, School District and parents agree that continued eligibility for the learner is not in question, the team can agree that a 3-year reevaluation is not needed.  If the team is in agreement, the decision is documented in the statewide IEP system.

When IEP teams consider learner reevaluations, there will be three paths:

  1. Reevaluation with additional data
  2. Reevaluation without additional data or
  3. Team determines reevaluation is not necessary.

In the coming school year, AEAs will work with staff to provide necessary support to implement this procedure as appropriate.

Relevant Iowa Code:

281—41.305(256B,34CFR300) Additional requirements for evaluations and reevaluations
